Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN . OPEN TO TEXAS RESIDENTS, 18+ ONLY. A PURCHASE DOES NOT INCREASE CHANCES OF WINNING. ENDS 6/28/23. VOID WHERE PROHIBITED. INTERNET ACCESS REQUIRED TO PARTICIPATE.
1. ELIGIBILITY AND CONTEST PERIOD. The Our Texas Our Future Sweepstakes (“Sweepstakes”) is open to legal residents of the state of the United States, who are eighteen (18) years of age or older at the time of entry (“Entrant”). Employees, officers, directors, and agents of H E B, LP (“Sponsor”) and its parents, subsidiaries, affiliates, retailers, and advertising or promotion agencies and vendors involved in this Sweepstakes (collectively, “Sweepstakes Entities”), and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and household members of all such persons, whether or not related, are not eligible to participate in this Sweepstakes. Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law. Sponsor reserves the right to verify the eligibility and all facts at any time, and entrants agree to cooperate in any verification process or request. Sweepstakes begins at 12:00:01 a.m. Central Time (“CT”) on May 15, 2023, and ends at 11:59:59 p.m. CT on June 28, 2023 (“Sweepstakes Period”).
2. HOW TO ENTER. During the Sweepstakes Period, Entrants must visit https://www.ourtexasourfuture.com and follow the onscreen instructions to complete the Sweepstakes entry form in its entirety (each an “Entry” and, collectively “Entries”). Free Internet access is available at H E B stores, and at many public libraries. Incomplete Entries are void.
3. LIMIT. Limit one (1) Entry per person/per email address. Any attempt to enter more than once by any means, including but not limited to, use of multiple identities, email addresses, accounts, or other means may result in disqualification from this and any other promotional offerings by Sponsor. Use of any macro, bot, script, or other automated means to submit Entries is prohibited. No responsibility is assumed for lost, late, damaged, misdirected, illegible, incomplete, or incorrect entries or other Sweepstakes materials, all of which are void, or for errors due to computer malfunctions, software errors, transmission problems, or interruptions in operations. Sponsor’s database computer is the official timekeeping device for the Sweepstakes. Proof of transmission is not proof of receipt. Entries will not be acknowledged or returned. In the event of a dispute over the identity of an online Entrant, Entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address at time of Entry. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
4. RANDOM DRAWING AND WINNER NOTIFICATION. A random drawing will be conducted on or about June 29, 2023, in San Antonio, Texas from among all eligible Entries received during the Sweepstakes Period by Administrator (an independent judging organization), whose decisions are final and binding in all respects. Entrants irrevocably agree to be bound by these Official Rules and by the decisions of the Administrator and/or Sponsor. The potential winner will be notified within two (2) business days from the drawing date, using the contact information provided at the time of Entry to confirm their eligibility. If the potential winner cannot be contacted or the notification is returned as undeliverable within seven (7) days after the attempt, or if the potential winner is not eligible to win a prize in accordance with these Official Rules, the prize may be forfeited, and an alternate winner may be selected at Sponsor’s discretion. Potential winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (“Prize Claim Documents”) within seven (7) days of notification attempt or prize will be forfeited and may be awarded to an alternate winner at the Sponsor’s discretion.
5. Prizes. Approximate retail value (“ARV”) of all prizes is Twelve Thousand Dollars ($12,000.00) total.
GRAND PRIZE (One (1) available): Grand Prize winner will receive a $5,000 H E B Gift Card, and a Texas State Parks’ limited edition ‘Texas Wild’ vinyl record, valued at $40. Grand Prize ARV: $5,040.
FIRST PRIZE (One hundred (100) available): First Prize winners will each receive a Texas State Parks Annual Pass Certificate, redeemable for a one-year Texas State Parks Pass usable for unlimited entry at Texas state parks for the passholder and guests. First Prize ARV: $70.00 each.
6. PRIZE TERMS. Winner is solely responsible for travel or other expenses associated with using any prize (including, without limitation, accommodations, transportation, meals, gratuities, fees, and incidentals). Gift Card is subject to applicable terms and conditions, including dormancy fees and expiration dates, if any, and may not be used by the winner for the purchase of alcohol or tobacco. Annual Pass Certificate is subject to applicable terms, conditions, and policies of the Texas Parks & Wildlife Department, including expiration date and requirement to redeem in person at a state park. Sponsor reserves the right to substitute prize of equal or greater value. Prizes will be shipped to address provided by winners four (4) to six (6) weeks after drawing, except the ‘Texas Wild’ vinyl record, which will be shipped when released. Winners are responsible for all federal, state, and local taxes, and all other costs associated with prize acceptance. Sponsor is not responsible for inability of winner to accept or use a prize, and a prize may be forfeited if winner cannot accept or use a prize. Sponsor is not responsible if a prize is lost, stolen, damaged, and/or destroyed. As a condition to receiving the Grand Prize, winner will be required to sign and return the Prize Claim Documents and complete, sign, and submit to Sponsor and/or Administrator an IRS Form W-9 or equivalent form with their full taxpayer identification number for prize eligibility. Prize is not transferable, and may not be substituted, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize or prize component for an equal or greater value in the event a prize or its components become unavailable.
7. ODDS. Odds of winning depend on the total number of eligible Entries received.
8. MISCELLANEOUS. All Entries made through any robotic, automatic, mechanical, programmed, or similar entry duplication method are void. Sponsor is not responsible for any (a) lost, late, misdirected, damaged, garbled, incomplete, or illegible Entries, all of which are void; (b) telephone, computer, mobile device, hardware, software, programming, or network malfunction, or other technical failures or errors, or the failure to properly process entries; (c) communication disruption or other forces beyond the reasonable control of the Sponsor, including but not limited to, disruption related to internet traffic, wireless networks, virus, bug, or non-authorized intervention; or (d) damage caused by a computer or mobile device related virus or otherwise resulting to any computer or mobile device from such person’s participation in the Sweepstakes, whether human, mechanical, or electronic. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted, or that fraud or technical problems, failures, malfunctions, or other unintended circumstances have impaired the integrity, administration, security, proper play, and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the end date, winner will be selected from among all eligible Entries unaffected by any error that were received as of the termination date. Persons found tampering with or abusing any aspect of this Sweepstakes, or who Sponsor believes to be causing malfunction, error, disruption, or damage, will be disqualified. Entries that contain errors, or are incomplete or received after the Sweepstakes Period, will not be accepted.
9. RELEASE OF LIABILITY. By participating, each Entrant releases Sponsor and the Sweepstakes Entities from any and against any and all injury, loss, or damage caused or claimed to be caused by their participation in the Sweepstakes and/or the acceptance, awarding, receipt, use, and/or misuse of the prize or any travel acquired through use of the Annual Pass Certificate, Texas State Parks Pass, or Gift Card, and each Entrant agrees that the Sweepstakes Entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes, the prizes, or any travel activities, except as expressly provided in these Official Rules. By participating, each Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, any prizes awarded, or any travel activities shall be resolved individually without resort to any form of class action; (b) any claims, judgments, or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; (c) under no circumstances will any Entrant be permitted to obtain any award for, and Entrants hereby waive all rights to claim, punitive, incidental, or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) the Sweepstakes, these Official Rules, and all related disputes shall be governed by the internal laws of the State of Texas without regard to principles of conflicts of laws; any disputes shall be resolved exclusively in the state or federal courts in the State of Texas; and Entrant expressly consent to the jurisdiction of said courts and waive any objection thereto.
10. WARNING. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH AN ATTEMPT BE MADE, ADMINISTRATOR AND SPONSOR RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES AND OTHER ASSOCIATED LEGAL COSTS) FROM ANY SUCH ENTRANT OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO SEEKING CRIMINAL PROSECUTION.
11. DATA. Entrants acknowledge and agree that by participating in the Sweepstakes and providing any personal information, subject to applicable law, Sponsor may collect and use such personal information provided for the purposes of conducting the Sweepstakes, for their internal purposes, and for Sponsor’s marketing and advertising activities. Entrant information received by Sponsor is subject to its privacy policy located at https://www.heb.com/privacy.
12. WINNER LIST. For the winners’ names, send a self-addressed, stamped envelope to: H-E-B, LP, Attn: Our Texas Our Future Winner List, 646 South Flores Street, North 1, San Antonio, TX 78204. Requests must be received no later than August 15, 2023.

This Sweepstakes is not associated with the Texas Parks and Wildlife Department, which (a) does not sponsor or endorse this Sweepstakes; (b) assumes no responsibility for the Sweepstakes; and (c) has no control over the Sweepstakes or the prizes.
